The USCIS has finalized new EB-5 filing fees, with the changes taking effect for applications postmarked on or after November 30, 2026. The new fee schedule more than doubles several investor-related fees, while the minimum investment amounts remain unchanged for now.

New Investor Filing Fees
From November 30, the I-526E petition fee will rise by approximately 114%, while the I-526 fee will also increase substantially. The new fees include a $75 technology fee. Regional Center investors must additionally pay the Integrity Fund fee.
Regional Center Costs Increase
Regional Centers will face some of the largest increases under the new schedule. The new I-956F project application fee is $42,675, while annual Integrity Fund fees will be $11,000 or $22,000, depending on the center’s size. The promoter registration fee will be $2,165.
However, the I-956 amendment fee will decrease to $9,835, compared with $47,695 under the previous fee schedule.
Investment Amounts Remain Unchanged
Despite the higher government fees, the EB-5 investment thresholds remain at $800,000 for investments in a Targeted Employment Area or qualifying infrastructure project and $1.05 million for investments outside these categories.
EB-5 provides conditional permanent residence to qualifying investors, their spouses, and eligible children, provided the investment creates at least 10 full-time US jobs.
Potential Investment Increase in 2027
A further change is expected on January 1, 2027, when the EB-5 minimum investment amounts are scheduled to be adjusted for inflation for the first time. The current $800,000 threshold could increase to approximately $940,000–$960,000, according to the analysis cited in the report.
This creates two important deadlines: November 30, 2026, for the new filing fees, and January 1, 2027, for the potential increase in the minimum investment amount.
